Slow Roll BJJ LLC - Waiver and Release of Liability Agreement

In consideration of being permitted to attend, watch, or participate in any way in the Brazilian Jiu Jitsu (BJJ) Program, Striking Program, Mobility Program, Yoga, or any future programs or events (whether on or off premises) provided by Slow Roll BJJ LLC (hereafter referred to as “Slow Roll BJJ”), including programs or activities offered under any "Doing Business As" (DBA) names registered under Slow Roll BJJ LLC, I, or if a minor, the parent(s) or legal guardian(s) of the minor guest named below (hereinafter, collectively “I,” “me,” or “my”), agree as follows:

1. Authorization to Charge Credit Card

By signing this waiver, I authorize Slow Roll BJJ LLC to charge the credit card provided at the time of my sign-up or any replacement card added to my account for the membership fees specified on my account. I understand that any cancellation of a month to month membership requires a 30-day written notice, which may be submitted via text, email, or mail. Any scheduled payments during this 30-day notice period will be processed as normal, and my membership will be canceled 30 days after receiving notice.

2. Program Participation

I voluntarily seek and consent to participate in Slow Roll BJJ’s BJJ Program, Striking Program, Mobility Program, Yoga, or any future programs held by Slow Roll BJJ, and any events hosted by Slow Roll BJJ, whether on or off premises, including transportation to and from such events. This waiver includes all business conducted under the name of Slow Roll BJJ LLC, including any business conducted under any DBA names registered under Slow Roll BJJ LLC.

3. Physical Examination

Slow Roll BJJ urges all participants to obtain a physical examination from a licensed physician before using any equipment or participating in any program. I acknowledge that participation in any program is at my own risk.

4. Acknowledgment of Risks

I understand and acknowledge that the activities of Slow Roll BJJ are inherently dangerous and could result in bodily injury, partial or total disability, paralysis, or death. I accept all risks, whether caused by my own actions or inactions, the actions of others, or the nature of the facilities and equipment used.

5. Assumption of Risks

I assume full responsibility for any injuries, illnesses, losses, or damages resulting from my participation in any program or event at Slow Roll BJJ, including those caused by equipment use or class participation. This includes, but is not limited to, injuries sustained in the BJJ Program, Striking Program, Yoga, Mobility Program, or any future programs.

6. Use of Facilities and Equipment

I agree to use all equipment and facilities provided by Slow Roll BJJ at my own risk. I hold Slow Roll BJJ harmless from any consequences resulting from such use, including injury or death, regardless of the cause.

7. Hold Harmless

I hereby release, waive, discharge, and covenant not to sue Slow Roll BJJ LLC, its affiliates, owners, managers, instructors, promoters, directors, officers, agents, employees, or any other associated persons, from all liability for any claims, demands, losses, or damages arising out of or related to participation in any programs or events hosted by Slow Roll BJJ.

8. Recovery and Liability Limitations

In no event shall my recovery exceed the total amount I have paid to Slow Roll BJJ for the program or event in which I have participated.

9. Cancellation of Agreement

I understand that I may cancel my membership by providing a 30-day written notice. Upon cancellation, I agree that any scheduled payments during that 30-day period will be charged as normal. If Slow Roll BJJ permanently closes, I will no longer be required to make payments, and any scheduled payments will be automatically canceled.

10. Default and Late Payment

If my monthly membership becomes more than 5 days past due, I will be charged a $10 late fee. For any returned checks, I will be charged a $25 fee.

11. Privacy Policy

I understand that Slow Roll BJJ will use my personal information solely for business purposes, and such information will not be sold, exchanged, or transferred to third parties without my consent.

12. Media Release

I authorize Slow Roll BJJ to take photographs and videos during classes, events, or activities, which may be used for advertising, promotional materials, or social media purposes.

13. Legal Disputes

Should any legal dispute arise out of this Agreement, or any subject matter related to the services provided by Slow Roll BJJ, I agree to pay all reasonable attorney’s fees and costs incurred by Slow Roll BJJ in defense of any such dispute.

14. Waiver of Claims

I hereby waive all claims against Slow Roll BJJ, its affiliates, employees, agents, or representatives, for any injury, death, or damages sustained during participation in any of Slow Roll BJJ’s programs, classes, events, or activities, including those occurring on or off premises or during transportation to and from events.

15. Heat and Increased Risk of Participation

Some adult competition and yoga classes at Slow Roll BJJ may be conducted in a heated environment. I understand that this heat can increase the physical demands of the classes, and it may elevate the risk of dehydration, heat exhaustion, heat stroke, or other heat-related injuries. By participating in these classes, I acknowledge the increased risk of injury or physical strain and agree to take personal responsibility for monitoring my own health, hydration, and overall physical condition. I understand that it is my responsibility to know and respect my limitations, and I will immediately stop participation if I feel unwell or unable to continue due to heat-related conditions. I am aware that Slow Roll BJJ recommends consulting with a physician before engaging in heated classes and I accept all risks associated with these activities.

I HAVE READ THIS RELEASE AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND I ACKNOWLEDGE THAT I HAVE BEEN GIVEN THE OPPORTUNITY TO SEEK OUT INDEPENDENT LEGAL ADVICE FROM A QUALIFIED ATTORNEY BEFORE SIGNING. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING THIS DOCUMENT, AND I DO SO FREELY AND VOLUNTARILY. By signing above, I agree to all the terms and conditions outlined in this waiver and release of liability agreement.
